On September 13, 2011, the New Products Corporation in Benton Harbor,
    Michigan filed a Lawsuit in Berrien County Circuit Court against Harbor Shores
    BHBT Land Development, LLC, Harbor Shores Golf Course, LLC, the City of
    Benton Harbor, Benton Charter Township, Whirlpool Corporation, PNC Bank and
    Michigan Magnet Fund E, LLC for trespassing and damages to New Products
    Property for golf course construction. Harbor Shores claims it legally acquired the
    New Products Property through a tax sale. New Products maintains that it is the
    "current legal and rightful owner of the real estate involved in this lawsuit..."

    The significance of this lawsuit in relation to Jean Klock Park is that a portion of
    Mitigation Parcel D may have been illegally obtained and ownership and title of
    privately owned land may very well have been fraudulently transferred into the
    possession of the City of Benton Harbor for public land use in exchange for the
    conversion of Jean Klock Park for a privately owned Jack Nicklaus Signature golf
    course. If these allegations are true it means stolen land was exchanged for, what is
    in our opinion, stolen land; namely the dunes and other publicly owned natural
    areas of JKP, now converted for a privately owned golf course development. It
    brings to mind the term 'land laundering.'

Files Lawsuit Alleging Golf Course and Park Mitigation
Trespasses on Company's Private Land!!!

    71.  Even though they have no valid claim to ownership of the
    Property (New Products Property), Harbor Shores BHBT Land
    Development, LLC have appropriated part of the Northen
    Portion of the Property for use of a golf course.

    72.  A part of the Northern Portion of the Property has
    purportedly been conveyed by Harbor Shores BHBT Land
    Development, LC to Benton Harbor, to be used as part of
    Mitigation Parcel D.

    73.  Defendant Whirlpool Corporation claims an interest in the
    Property through a mortgage. Furthermore, upon information
    and belief, Whirlpool also has a financial interest in either or
    both harbor Shores Defendants.  

Jean Klock Park Mitigation
Parcel D is a 5.61 acre parcel that
is bordered by Klock Road, North
Shore Drive, warehouses and a
golf course. Outlined in yellow is
a portion of the land ownership
dispute that happens to be located
on Mitigation Parcel D.
