In light of the National Park Service's decision to reject the
    conversion and mitigation proposal (land swap) for Jean Klock
    Park, the Army Corps of Engineers sent an e-mail to JFNew, a
    consulting firm associated with the development, informing them
    that:

    "At this time we do not consider it in our interest to devote
    additional time and resources to evaluate an application that
    may change."

    The Army Corps realized that without the three holes at Jean
    Klock Park that Harbor Shores' plans will have to be revised
    which means that additional time spent on the permit could not be
    justified.

    On November 9, 2007, the Army Corps sent a formal letter of
    denial for the Harbor Shores permit application citing regulations
    and stating that:

    "Work can only be accomplished after receipt of a DA permit.
    There is no assurance that you will receive a DA permit after
    satisfactory resolution with NPS."
